Should judges making custody decisions by listening to the kids? Nowadays this is a hot subject in Family Law. Years ago the answer to the question was an emphatic "no". Kids were unreliable witnesses, they did unknown exactly what was good for themselves, and they would be traumatized forever by being asked to select one moms and dad over the other.
